Autel Mapper App Privacy Policy

Welcome to use the Autel Mapper Windows application and related services (hereinafter referred to as "Autel Mapper") of Autel Robotics ("we" or "us")! We understand the importance of personal information to you, and will do our best to protect your personal information and data safely and securely. In view of this, we have formulated this Privacy Policy in accordance with applicable laws and regulations and national standards, and in accordance with the mature security standards of the industry. Please read, understand and agree to this Privacy Policy before using the Autel Mapper. By using the Autel Mapper, you consent to the privacy practices described in this Policy.

This Privacy Policy applies to the functions and services of the Autel Mapper itself and does not apply to any products or services provided by any third party through the Autel Mapper (hereinafter referred to as the " third-party services "). Before you choose to use a third-party service, you shall fully understand the product functions and privacy protection policies of third-party service.

This privacy guide will help you understand the following.

1. How Do We Collect Your Personal Information

We may collect your information about you directly from you, from third parties, and automatically through your use of the Autel Mapper. Some information we collect from you are referred to as "personal information" or "personal data" in this Policy. Personal information or personal data is data that can identify you, or data that we can relate to you. This section describes the different types of personal information we collect from you and how we collect it.

The following is a high-level summary of the types of personal information we use:

1.1 Information You Provide to Autel Robotics When You Register

You need to register an account to enjoy certain features or services. When you register the Autel Mapper, we may ask you to provide the corresponding personal information, such as your name, email address, phone number, user ID, password or other information for account verification. Autel Robotics will take reasonable and necessary measures to protect the security of the aforementioned information.

1.2 Purchase and Deliver Products or Services

When you place an order with Autel Robotics, or contact us for customer service, you may provide us with your contact information including your name, alias, ID number, email address, shipping address, billing address and phone number(s). If you do not provide these information, you may not be able to purchase Autel Robotics products and services. If you need us to provide other services during the ordering process, you may need to provide the personal information necessary to realize such services, for which we will obtain your authorization and consent separately. After placing an order, you can choose the payment services provided by the third-party payment institutions cooperating with the online mall (such as UnionPay, Alipay, WeChat Pay and other payment channels, hereinafter collectively referred to as " payment agencies"). Autel Robotics does not collect your personal information through the payment function itself, but we need to share your order number and transaction amount information with these payment agencies, and obtain the corresponding payment information (for example, payment completion status, etc.) from the payment agencies to help you complete the payment. If you choose UnionPay, we will collect your card number (we will provide your card number to UnionPay, but we will not store your card number), the payment identification number assigned to you by UnionPay, and other personal information that UnionPay requires us to collect and share.

1.3 Information Obtained by Autel Robotics in the Course of Your Use of the Products or Services

In order to ensure the proper implementation of the corresponding functions of our products and services, we will collect information about your device, such information includes:

1.2.1 Device and Application Information. Such as computer configuration information, software activation time, hardware model, OS version, application version, software identifier, device and application settings (e.g. region/language/time zone/font/phone recording), etc.

1.2.2 Log Information. When you use the relevant functions of Autel Mapper App, Autel Robotics will collect certain information with your consent and store it in local logs, such as registered user name, APP version, firmware version information, words or photos you shared, use of relevant functions or services Access time, access times, event information (such as detection results, errors, crashes, reboots, upgrades), etc. This information can be manually uploaded by the user to Autel Robotics ' server.

1.2.3 Information You Upload to the Server of Autel Robotics. For example, product error records, repair requests, inspection records, etc. that you choose to report will be stored on the server for your quick access and review of relevant event progress or records.

1.4 Information from Third-party Sources Where permitted by law, Autel Robotics may also collect other information about you, your equipment or use of the services in other ways that will be explained to you at the time of collection, or with your consent.

1.5 Non-identifying Information Non- identifying information refers to information that cannot be used to identify individuals, such as the number of times a function is used, website visits, app downloads, product sales, etc. Autel Robotics will collect aggregated statistical information for the purpose of understanding how users use our products and services, so that we can improve our products and services and better meet their needs. Autel Robotics may, in its sole discretion, collect, use, disclose, and transfer non-identifying information for other purposes.

2. How Do We Use Your Personal Information

We strictly abide by the provisions of laws and regulations and the agreement with users, and use the collected information for the following purposes in accordance with the provisions of this Privacy Policy:

2.1 To Improve Products and Services and Conduct Data Analysis.

We may conduct statistics and analysis of product usage to improve our products and services, and conduct necessary business operations and data analysis, such as operating products or providing services, evaluating, maintaining and improving product functions, developing new products or services, and providing customer support. These statistics will not include any identifying information about you. We invite you to join Autel Robotics Product Improvement Program to help us design new products and services, or improve our existing products and services, if you agree that we may collect the following information from you: your diagnostic data and usage data, device identification number (such as MAC address), device attribute information, account information, etc. If you choose not to join the Product Improvement Program for the time being, it will not affect your use of Autel Robotics products or services.

2.2 Security Assurance.

To ensure the security of your account, we will use relevant information to help improve the security and reliability of APP services, including detection, prevention and response to fraud, abuse, illegal behaviors, security risks and technical issues that may harm the Autel Mapper or your account.

2.3 Communication with You.

We will use the information collected (such as email address, phone number, etc.) to communicate with you directly. We may let you know about upcoming changes or improvements to the Autel Mapper App.

2.4 Provide Inquiries and Advertisements of Interest to You.

To contact you for administrative and informational purposes, including for customer service. We may send direct marketing such as communications, including updates on promotions and events, relating to products and services offered by us and by third parties we work with. If you are an individual or consumer we will only send you direct marketing with your consent or as permitted by applicable law. You may send unsubscribe requests or withdraw your consent at any time.

2.5 To comply with applicable laws and regulations.

According to relevant laws and regulations, we may collect and use your personal information without seeking your authorization under the following circumstances:

1. Related to our performance of duties and obligations prescribed by laws and regulations;

2.6 If you are located in the European Economic Area, we will only use your information when we have a valid legal ground, including when:

3.1 Share

We will not disclose your information that we collect through the Autel Mapper to third parties except as described in this Policy. We may disclose information to third parties in the following circumstances:

3.1.1 Obtain your express consent

Upon your prior consent, we may provide your personal information to third parties. We will clearly inform you of the purpose and type of information provided, and provide it in accordance with the requirements of relevant laws and regulations.

3.1.2 Necessary for the implementation of third party services

3.1.2.1 We may make certain aggregated, de-identified, or non-identifying information about users of the Autel Mapper available to third parties for various purposes, including (i) compliance with various reporting obligations; (ii) for business or marketing purposes; (iii) product safety analysis; or (iv) to assist such parties in understanding our users' interests, habits, and usage patterns for certain programs, content, services, advertisements, promotions, and/or functionality of the Autel Mapper.

3.1.2.2 In order to ensure the stable operation and functional realization of the Autel Mapper and enable you to use and enjoy more services and functions, we may embed SDK or other similar applications of authorized partners in the Autel Mapper according to the needs of product function realization. We will carefully evaluate the purpose and mode of use of third parties. Unless otherwise authorized by you or provided by laws and regulations, third-party SDK operators have no right to use your personal information for any other purpose.

3.1.2.3 We work with third parties' service providers to provide payment facilitation, parcel transportation, application development, traffic monitoring or analysis, electronic messaging, and other services for us. We require these service providers to use or disclose the information they process on our behalf, only as necessary to perform services on our behalf or comply with legal requirements.

3.1.3 Transfer

We will not transfer your personal information to any company, organization or individual except in the following cases:

A. Transfer with express consent: with your express consent, we will transfer your personal information to other parties;

B. In the case of merger, acquisition, bankruptcy liquidation or business transfer between Autel Robotics and its affiliates, if personal information transfer is involved, we will inform you of the name and contact information of the new company or organization holding personal information. We will require the new company or organization holding your personal information to continue to be bound by this policy, otherwise we will require the company or organization to seek authorization from you again.

3.1.4 Disclose

We will publicly disclose your personal information under the following circumstances:

3.1.4.3. We also reserve the right to preserve and disclose your information that we believe, in good faith, is appropriate or necessary to (i) take precautions against liability, (ii) protect ourselves or others from fraudulent, abusive, or unlawful uses or activities, (iii) investigate and defend ourselves against any third-party claims or allegations, (iv) protect the security or integrity of the Autel Robotics Products and Services and any facilities or equipment used to make the Autel Robotics Products and Services available, or (v) protect our property or other legal rights (including, but not limited to, enforcement of our agreements), or the rights, property, or safety of others.

4. How Do We Protect Your Personal Information

The personal information we collect adopts the principle of necessity, that is we only collect the minimum information required for the purpose of that product's business functions. For personalized user experiences, you explicit consent will be required, and we fully follow any applicable data protection regulations in the US, such as California Consumer Privacy Act of 2018(CCPA).

In addition, We have taken reasonable and practicable technical security and organizational measures to protect the personal information collected in connection with the Services from unauthorized access, public disclosure, use, modification, damage or loss of personal information, include the followings:

(1) We encrypt the transmission channel using mainstream security technology means such as SSL/TLS. We regularly review our information collection, storage and processing practices (including physical security measures) to avoid unauthorized access to or tampering with various systems.

(2) We have appointed a person in charge of personal information protection,We have also established relevant internal control management processes, and we control access to personal information with strict authority based on the principle of minimal authorization, employees who have access to such information are subject to strict contractual confidentiality obligations, and if they fail to meet these obligations, they may be held legally responsible or have their relationship with us terminated. Access logs to personal data will be recorded and regularly audited. For employees who need to access sensitive personal information, their access rights will be approved by the person in charge of personal information protection or relevant management, access will be recorded, and technical measures will be taken to avoid illegal access, modification, copying, and downloading of personal information.

(3) We strictly select business partners and service providers, and implement the requirements on personal information protection into the business contract or audit and evaluation activities of both parties.

(4) Internal promulgation and implementation of data security management norms to clarify the protection standards and requirements for user data (including user personal information)

(5) We conduct security and privacy training courses, tests and campaigns to raise awareness among employees of the importance of protecting personal information.

(6) We adopt international and industry-recognized standards to protect your personal information, and actively pass relevant security and privacy protection certifications such as ISO 27001, and establish good coordination and communication mechanisms with regulators, third-party security service providers, and testing and certification agencies to timely resist and deal with information security threats and protect your personal information and privacy.

(7) If an information security event occurs with a very small probability, after the occurrence of the incident, we will inform you in a timely manner in accordance with the requirements of relevant laws and regulations: the basic situation of the security incident and the possible impact, the disposal measures we have taken or will take, the suggestions you can independently prevent and reduce the risk, the remedial measures for you, etc. We will promptly inform users about the incident by email, letter, telephone, push notification, etc. When it is difficult to inform the subject of personal information one by one, we will take a reasonable and effective way to publish the announcement. At the same time, we will also take the initiative to report the disposition of personal information security incidents and take measures to reduce any resulting risks in accordance with the requirements of regulatory authorities.

5. Children's Privacy

Our products and services are geared towards adults. Children are not allowed to create their own user accounts without parental or guardian consent. Except for certain products that are marked as "14+" or "for customers over the age of 14", Autel Robotics Products and Services are not directed to children under the age of 16. We do not knowingly collect information from children under the age of 16 without obtaining parental consent. If we find that we have collected personal information about children without prior verifiable parental consent, we will seek to delete the data as quickly as possible.

6. Your Rights

6.1 You may update, correct, or delete certain Autel Robotics account information and preferences by accessing your account preferences page, available through certain Autel Robotics Products and Services, including the autelrobotics.com and various mobile applications. If you receive commercial email or text messages from us, you may unsubscribe at any time by following the instructions contained within the email or text message. You may also opt out from receiving commercial email or text messages from us or object to be profiled by sending your request to us by email at sales@autelrobotics.com.

6.2 If you are located in the European Economic Area, you may also have the right to request access to additional information, including the right to request access to and receive certain information we maintain about you; to update or correct inaccuracies in the information we maintain about you; to receive a copy of the information which you provided for its transmission to another company; to object to the processing on grounds relating to your particular situation; and to have the information blocked, deleted, or erased, as appropriate. When we process personal data on the basis of your consent, you can also withdraw your consent. If you withdraw your consent, we will apply your preferences going forward, and this will not affect the lawfulness of the processing before you withdrew your consent.

Note, however, that if you exercise your right to object or your rights of blocking, deletion or to be "forgotten" or if you decline to share certain information with us, or if you withdraw your consent to our processing of information about you, we may not be able to provide to you some, or any, of the features and functionality of the Autel Mapper.

6.3 Likewise, if you close your Autel Mapper App account, you will not be able to sign in to the Autel Mapper or access any of your information. However, you can open a new account at any time. Please note that while any changes you make will be reflected in active user databases within a reasonable period of time, we may retain all information you submit, as authorized under applicable law, for backups, archiving, prevention of fraud and abuse, analytic, satisfaction of legal obligations, or where we otherwise reasonably believe that we have a legitimate reason to do so. In addition, if certain information has already been provided to third parties as described in this Policy, retention of that information will be subject to those third parties' policies.

6.4 We provide you with a way to cancel your account. If you meet the conditions of our Terms of Service and the relevant national laws and regulations, you can cancel your account through the account cancellation function of the Autel Mapper. After your account is canceled, the server will automatically delete the uploaded logs and other information, and we will stop providing all or part of the services to you, and delete or anonymize your personal information upon your request, except as otherwise provided by laws and regulations.

6.5 In some business functions, we may make decisions based solely on non-human automated decision-making mechanisms, including information systems, algorithms, etc. If these decisions significantly affect your legal rights, you have the right to an explanation. If these decisions significantly affect your legal rights, you have the right to seek an explanation from us and we will provide appropriate remedies.

6.6 In responding to your request as described above, you may be required to provide a written request or otherwise prove your identity for security purposes. We may ask you to verify your identity before processing your request.

In principle, we do not charge a fee for your reasonable requests, but we will charge a cost for repeated requests that exceed reasonable limits, as appropriate. We may deny requests that are unnecessarily repetitive, require excessive technical means (for example, requiring the development of new systems or fundamental changes to current practices), pose a risk to the legal rights of others, or are highly impractical (for example, involving backups of information stored on tapes).

7. Third-party Technology and Services

To ensure the stable operation of the Autel Mapper or realize relevant functions, we may access the software development kit (SDK) provided by a third party to achieve the aforementioned purposes. We will strictly review the SDK from which our partners obtain personal information to protect your personal information security.

Please note that the personal information processing type of third-party SDK may change due to version upgrade or policy adjustment. Please refer to their published official instructions.

8. International Transfers of Personal Data

Your information collected by the Autel Mapper App may be transferred to and accessed by Autel Robotics entities and business partners globally to provide Autel Robotics Products and Services to you. We will provide the same level of protection as set forth in this policy regardless of the location of processing.

9. Scope of Application

The products and services applicable to this Privacy Policy are provided by Autel Robotics.

Please note that this Privacy Policy does not apply to services provided by any third party. Your use of such third-party services is subject to the privacy policy of the third party. You shall carefully read and understand the privacy policy of the third party.

10. Revision and Alteration

We may update this Policy from time to time. We will not reduce your rights under this Policy without your express consent.

For any updates or revisions to this Privacy Policy, we will display the changed Privacy Policy to you in the form of an announcement, push notification or pop-up window. If we make any material changes to this Privacy Policy in accordance with applicable laws and regulations, we will notify you through the Autel Mapper or other appropriate channels and obtain your consent again.

11. Miscellaneous

This Agreement shall be implemented in accordance with the California Consumer Privacy Act and the American Data Privacy and Protection Act, etc.

No matter the terms of this Agreement are partially invalid or unenforceable for any cause, the remaining terms shall remain valid.
